Can I Place My Baby for Adoption Even if the Birth Father Disagrees?

Adoption laws vary from state to state. Everything from a birth father’s rights to the number of days you must wait before signing the Consent to Adopt varies by state. If you are not married to the birth father, you are free to make an adoption plan for your child, even if he disagrees. 

Laws change regularly, and adoption laws are no exception. Choose a reputable adoption coordinator who knows Kentucky’s adoption laws. Here is some information to consider before placing your baby for adoption.

A Birth Father’s Rights

The National Council for Adoption lists rights that birth fathers have in each state. Every adoption situation is unique according to the relationship between the biological parents. 

Knowing each state’s laws for determining paternity and a birth father’s rights is essential. Make sure the adoption coordinator you choose is fully licensed in Kentucky and has a thorough grasp of adoption laws. 

A Birth Mother’s Rights

Before your child is born, your rights are like those of any expectant mother. You have the right to know your options, including adoption and parenting. If you are considering placing your child for adoption, you have the right to change your mind at any time before you sign legal papers. 

In Kentucky, you must wait at least 72 hours after the child’s birth before signing the Consent to Adopt. Here are a few of your additional rights as you move forward with an adoption plan:

  • The right to have counseling before, during, and after the adoption
  • The right to obtain prenatal medical care
  • The right to thoroughly understand the adoption process from start to finalization
  • The right to choose the adoptive family for your child
  • The right to select the best adoption plan for you: open, semi-open, or closed
